Wigwam Nurseries Limited holds a great deal of information about the children in our care and their families. Some of it is sensitive. This statement sets out, in plain terms, how we look after it and what you can expect from us.
Our Privacy Policy gives the full detail of what we collect and why. This statement is the shorter summary of our commitments.
Who is responsible
Wigwam Nurseries Limited is the data controller. We are registered with the Information Commissioner’s Office under reference ZA363511.
David Wiggam is our Data Protection Co-ordinator and is responsible for our compliance with data protection law. He can be contacted at admin@wigwamnurseries.co.uk. Each nursery manager is responsible for the records held at their own setting, and our senior staff have undertaken data protection training.
Our commitments
We will:
- collect only the information we actually need
- tell you what we are collecting and why, at the point we ask for it
- keep it accurate, and correct it promptly when you tell us something has changed
- keep it secure, and limit access to the staff who need it
- keep it only for as long as we are required to, then destroy it securely
- never sell it, and never share it for marketing
- share it outside the nursery only where the law requires or permits, and where it is in the child’s interests
Sensitive information about children
Caring for a child properly means knowing about their health, their allergies, their medication, any additional needs and anything affecting their safety. The law treats this as special category data and sets a higher bar for handling it.
We collect it because we cannot keep your child safe without it. It is seen only by the staff at your child’s nursery who need it in order to care for them, and by management where necessary. It is not used for any other purpose.
Safeguarding
Our first duty is to the children in our care. Where we have a concern about a child’s welfare or safety, we will share information with social care, the police or other safeguarding partners, and we will do so without your consent and, where appropriate, without telling you first, if telling you would place the child at greater risk.
This is not an exception we take lightly, but it is the one circumstance in which a child’s safety comes before your preferences about your information.
CCTV
All of our settings use CCTV. Cameras outside the building protect the premises. Cameras indoors are used to monitor children while they sleep, so that a child can be watched over continuously without their sleep being disturbed. Recordings are overwritten after 10 days unless one needs to be kept, for example after an accident or where there is a safeguarding concern, and access is limited to management.
Photographs
We only use a photograph of your child where you have given permission, and you can withdraw that permission at any time. We do not post photographs of children on social media. Photographs used for publicity appear on our own website only.
Staff and access
Staff can only see the records for the nursery they work at. Everyone has their own account rather than a shared login, so it is clear who has looked at what. Accounts are removed when someone leaves. Staff receive data protection guidance as part of their induction and are expected to follow it.
If something goes wrong
If personal information is lost, disclosed to the wrong person or accessed without authority, we will investigate it, record it and act to limit the harm. Where a breach is likely to present a risk to the people affected, we will report it to the Information Commissioner’s Office within 72 hours of becoming aware of it, and we will tell the people affected where the risk to them is high.
Your rights
You can ask to see the information we hold about you or your child, ask us to correct it, ask us to delete it where we are not required to keep it, or object to how we are using it. Requests should go to David Wiggam at admin@wigwamnurseries.co.uk. The law allows us one month to reply, and for a request to see your child’s records we aim to respond within 15 working days.
Where we have asked for your consent, for example to use a photograph of your child, you can withdraw it at any time and we will stop. Withdrawing consent will never affect your child’s place or the care they receive.
Raising a concern
If you are unhappy with how we have handled information, speak to your nursery manager or email admin@wigwamnurseries.co.uk. We would always rather hear about it and put it right.
You can also complain directly to the Information Commissioner’s Office at ico.org.uk/make-a-complaint or on 0303 123 1113. You do not have to come to us first.
Review
This statement is reviewed at least once a year, and whenever our systems or our legal obligations change.
